摘要
介绍美国法中的劳动豁免制度,分析美国联邦最高法院为工会的集体协商行为创设的非成文法上的反垄断豁免的实践和理论根据,总结了美国职业体育领域的若干判例对适用该豁免制度而形成的"三要件"标准。特别研究了布朗案对非成文法中的劳动豁免制度的重要影响和挑战。以此为基础,论证了集体协商制度和劳动豁免制度对未来中国职业体育的市场化的借鉴意义。
This paper examines the law of Labor Exemption in the U.S,and analyzes the theory and practice of Non-statutory Exemption which is issued for Labor Union's collective bargaining by U.S.Supreme Court.It also summarizes the criterion of Three-Essential developed from several cases in sports industry,of which the Brown Case is the most typical and brings important effects and challenges to the Non-statutory Labor Exemption.It holds that Collective Bargaining and Non-statutory Labor Exemption deserve to be studied for sports industry in China.
