摘要
随着当代社会生活的发展,作为社会管理创新过程的一个侧面,教育行政主体在本体观、资格观、权利(力)义务观等多方面发生了一系列变化,对教育行政体制创新产生了深刻影响,突出表现为:一是当社会公共生活形态发展到一定阶段时,法律对教育行政主体的择入范围趋宽而资格条件趋严,主体类型趋于多元化,以满足教育领域里管理创新的需要;二是当法治真正成为一种国家意志时,教育行政主体的权利(力)呈瘦身趋势,而义务呈加重趋势,以两者的均衡张力推动教育行政体制更加公平正义。未来,与教育行政主体相关的体制机制创新还将继续。
The research on educational administration subject is a basic field in the study of educational administration system,which ranges from people's ideas about its noumenon,qualification,scope,classification to its rights and obligations.As one side of social management innovation,the connotation of educational administration subject has rooted in all above ranges,and has affected the system profoundly as follows: firstly,when social life changes into certain new pattern,the law would expand the scope of educational administration subject,and meanwhile make stricter requirements for its qualification,in order to meet the innovative needs of educational administration,thus this leads to subject structure diversity;secondly,when public belief on legality has become the will of state,the rights of educational administration subject would be appropriately decreased while the obligations would be increased,so as to build an educational administration system with better balance and more justice.Therefore,the institutional innovation will still go on in the future.
