摘要
诉讼救济的有限性与非讼救济的非中立、程序规范的缺乏及纠纷解决效力的不确定性等共同构成了当前我国教师权利救济的困境,故对我国教师权利救济必须要进行相应的改革与完善。从宏观层面上看,完善我国教师权利救济机制时应予遵循或考虑:确保救济机构的中立性、程序性规范的完善、处理决定效力的确定性及借鉴当前知识产权"三审合一"模式完善教师权利的诉讼救济等。
The lawsuit relief's finiteness and the non-lawsuit relief's non-neutrality,lack of the procedure code's guarantees,dispute resolve's uncertainty are the plight of teacher rights relief in China which need to be reformed and improved.Viewing from a macroscopic perspective,when improving teacher rights relief mechanism,we should consider such measures as to ensure the relief agencies' neutrality,to improve the regularity of the procedure and certainty of the dispute resolving and to learn from the model of intellectual property cases' of "the merging of three kinds of proceedings" to improve the lawsuit relief of teachers' rights.
