摘要
运用富含自足性与自治性等法理意义的ADR解决物业管理纠纷对于当事人来说,或许在实体权益上需做出退却,但能节省更多成本,获得更多尊重和相比诉讼而言更好的效果。实证表明,ADR乃化解物业管理纠纷的良径。而ADR的制度建设,更是其长远有效发展的必要保障。
ADR(Alternative Dispute Resolution)characterized by its jurisprudential significances in self-sufficiency and self-governing,in practice,has manifested itself as a more favorable solution for parties in the disputes arising from Property Management than lawsuits in terms of its cost-efficiency and respect for free wills of parties involved,though at probable expense of substantive interests.Therefore,it follows that the necessity of institutional building of ADR will be of great significance in safeguarding its prospective sound development.
