The Procedural Justice in the Construction of China's Modern Legal Culture

法律文化现代化是中国法治建设的重要组成部分,现代法律文化建设受到诸方面因素的影响。程序公正以及与程序公正相关的法律制度在我国传统法律文化中不健全、不完善,是制约我国现代法律文化建设的主要因素之一。从而提出程序公正对建设现代法律文化的重要性,摒弃传统法律文化重实体轻程序的观念,不断完善程序公正理论,从而推动现代法律文化的建设和社会主义法治国家的全面实现。

Modernization of legal culture is an essential part in the process of constructing the rule ot law m China, with various influences upon the constructing process of modern legal culture. The paper believes that the imperfection in procedural iustice and laws relating to it ex ists in China＇s traditional legal culture, which forms one of the major elements hindering the constructing process of China＇s modern legal culture. Therefore, the importance of procedural justice is introduced into the process of modern legal culture construction in this paper. By abandoning the traditional notion of placing more emphasis on entity than on procedure, it tries to improve the perfection of the theory of procedural justice, thus promoting the construction of modern legal culture and the full implementation of socialist legal system country.
