Economic Logic Hidden in Law——Economic Analysis of Law and Its Theoretical Expression

法经济学就是"将经济学的理论和经验主义方法全面运用于法律制度分析"的学科,是经济学意识形态向法律领域的扩张。在过去五十余年中,法经济学的演进过程一直充斥着各式各样的意见,表现为各种法经济学派的并存与纷争。但在这场学术运动中,却是始终存在着两条清晰的发展进路:科斯进路与波斯纳进路。波斯纳进路,即法律的经济分析,也就是"以经济学概念和工具去揭示法律中蕴涵的经济逻辑"。本文拟就"法律的经济分析"及其理论表现进行梳理和探析。

Law and Economics are the subject to totally applying the theory of economics and the method of empiricism to analyze legal institution.It is expansion of economic ideology to law field.In the past fifty years,gradual progress of law and economics was always full of virous opinions and all kinds of disputes.But two disdinct developmental progresses are present in this academic campaign all the way:Coarse’ s progress and Posner’s progress.Posner’s progress is economic analysis of law,which applies economic concepts and tools to reveal economic logic hidden in law.Economic analysis of law and its theoretical expression will be carded and discussed in the paper.
