小区车位归属问题的立法现状思考与完善设想

Legislation and Perfect Vision of the Ownership Disputes Residential Parking Spaces

现今我国的法律体系中,《物权法》74条一定程度上给解决小区车位所有权归属争议提供了解决方案,但也存在一些缺陷,这些缺陷使得该条文不能很好地应对现实生活中复杂的小区车位所有权归属争议。本文立足于我国目前的立法现状,从我国物权法有关小区车位所有权归属问题的立法不足入手分析,提出了完善物权法中有关小区车位所有权归属问题的立法不足的相关设想。

In China＇s legal system today,＂Property Law＂ 74 provide a solution of the settlement of ownership disputes residential parking spaces to some extent,but there are some weaknesses which makes the provision can not be a good response to real-life residential parking spaces in the complex attribution of ownership disputes.This paper is based on the status of current legislation,start to analyze from the parking area of property law on the ownership of the inadequacies of ownership,points out some visions by improving the parking area of property law related to the ownership of the inadequacies.
