合作创新背景下的我国国防知识产权政策分析

Military Intellectual Property under the Background of Cooperative Innovation

在"军民结合、寓军于民"的新形势下,原有的国防工业合作创新发生变化,军民之间、国际间的合作创新越来越频繁。合作创新中的国防知识产权问题日益凸现。本文首先分析了国防知识产权所独有的保密性等特点。在此基础上,深入剖析国防知识产权与合作创新的矛盾冲突,指出我国目前的国防知识产权政策对合作创新更多表现为一种约束机制。作为重要的借鉴参考,本文分析了西方主要经济发达国家在国防知识产权方面的政策经验。最后,针对现有国防知识产权制度的改革、完善,给出了几点建议。

With the new situation of civil-military integration and combining military with civilian support,traditional cooperative innovation is changing.Cooperative innovation between civil and military,or among international countries become more and more frequent.The problem of military intellectual property is increasingly apparent.Firstly,characteristics of military intellectual property are analyzed.Secondly,conflicts between military intellectual property and cooperative innovation are studied.The constraint mechanism of military intellectual property for cooperative innovation is pointed out.As important reference,the experience and policy of military intellectual property in major western developed countries are given.Finally,some suggestions for military intellectual property in our country are proposed.
