Study on the Acquisition of Rural Residential Land Use Right

我国农村宅基地使用权集社会保障性和物权性于一身,现行的宅基地使用权取得制度着重强调其社会保障性而忽视了其物权性,导致产生了现行取得制度中所有权人主体虚位、权能缺失、程序不合理、取得方式相互矛盾等问题。因此,在强化宅基地使用权的物权性的基础上,应当建立健全完善的宅基地使用权取得制度。

The quality of social security and the quality of property are fused together in rural residential land use right. Current acquiring system of residential land use right weighs social security but ignores property, thus leads to nullity of subjects, loss of rights and power, unreasonable procedure, inconsistent acquiring approaches, and so on. Therefore, on the basis of strengthening the property quality of residential land use right, the relevant acquiring system should be set up and perfected.
