在人类社会步入信息时代的今天,随着互联网技术的迅猛发展及计算机的广泛运用,电子商务合同越来越多,大大提高了交易效率,节约了成本。与传统合同相比,电子商务合同有许多新特点,明确电子商务合同的订立、成立和生效及其主体身份的认定、和效力认定等新问题,不仅可以保障交易各方的利益,还可以保障电子商务的顺利发展,为我国的司法实践提供有价值的参考。
