为探究渔业标准与专利在促进技术创新、推动创新成果的传播和应用、规范行业生产等方面的作用,理清专利权同渔业标准化的关系,解决渔业标准采用专利遇到知识产权的问题,通过对我国渔业行业标准与专利以及国外标准与专利的政策和现状的调查研究,运用对比的方法,找出处理我国渔业标准和专利结合所带来问题的方法是:完善相关法律法规体系,防止由此引发技术垄断和知识产权滥用问题;培育具有专业水平和实务经验的人才队伍,积极参与国际竞争,应对发达国家的专利布局策略;建立渔业行业标准和专利指导、管理体系,正确引导科研单位、专业院校及企业制定标准和申报专利。保障标准和专利相结合能节约人力物力,真正产生经济效益,有利于行业健康发展。

Studies were carried out to investigate the role of fishery standard and patent in promoting technological innovation, boosting the transferring and application of the innovations, and regulating the industry production. The relationship between patent rights and fishery standardization was clarified and the intellectual property issues caused by the adoption of patent in fishery standard were discussed. The countermeasures to deal with the problems caused by the combination of fishery standard and patent was proposed through investigation and study of the policy and current situation of fishery industry standards and patent in foreign countries and China. The countermeasures include： im- provement of relevant laws and regulations ; protection of the abuse of intellectual property rights and technical monop- oly caused by it ; fostering the talent team that have professional level and practical experience; actively participating in international competition; responding to the patent strategy of developed countries; establishing patent guide and management systems and fishery industry standard; correctly guiding the standard formulation and patent declaration for R＆D institutions, specialized academies, and manufacturers; ensuring the combination of standard and patent to save manpower and material resources, to produce economic benefits for facilitating the healthy development of the industry.
