人民调解协议司法确认制度之初探

人民调解的优势具有主动简捷、及时和经济及广泛的特点。人民调解协议司法确认程序是非诉讼程序,属于民事司法程序;确认调解协议前法官须向当事人履行询问、释明的义务;启动人民调解协议司法确认,当事人需向法院交纳相应的申请费;人民调解协议司法确认程序的期限限制在5—10个工作日内。若调解协议所涉及的法律关系较为复杂,则可在10个工作日的基础上增加5个工作日。应尽快建立司法确认程序,为人民法院审查确认人民调解协议提供程序法依据,使人民调解协议的司法确认制度不但有实体法依据,而且有程序上的保证,具有可操作性。

The advantage of civil mediation is active,brief,timely,economical and extensive.The validation procedure of it is not a lawsuit,but a civil judicial process.Before validating the mediation agreement,the judge should inquire and explain to the party concerned;after the startup of the agreement,the party concerned should pay application fee for the court;the time limit of validation should be in 5-10 workdays to decide it valid or not.If the relation in the agreement is complicated,then 5 workdays would be increased.After the recognition,the judicatory confirmation procedure should be built up to adopt suitable legal document,and provide lawful procedures,to make the civil mediation recognition system have the support form the concrete laws and procedure laws with maneuverability.
