论农村留守儿童监护制度的完善

On Perfecting the Guardianship System of Children Left at Home in the Rural Areas

农村留守儿童的监护现状存在着严重问题,必须明确法定监护、区分亲权与监护并通过国家公权力的介入,设立国家监督机关和社会监护机构,在立法中明确委托监护制度,保护监护人的正当权益等方式,健全农村留守儿童监护制度,保护农村留守儿童的权利。

The current situation of guardianship of the children left at home in the rural areas has faced up a great variety of problems. By analyzing the status of the children in the rural areas and based on the laws and regulations of guardianship, this paper argues that it is necessary to distinguish the kinship and guardianship, set up supervisory body and social guardian institutions, specify the system of guardianship in legislation to protect the guardian＇s lawful rights, and improve the guardianship system for the children left at home in the rural areas so as to protect their rights.
