Equal Right to Language in Due Process——Practice of Court Interpretation in Litigation with Foreign Elements

司法实践的需要对我国法庭翻译制度的构建提出了迫切要求。本文首先介绍了法庭翻译的法理依据和法律规定;接着从实证角度归纳了我国法庭翻译制度的现状,指出了其在实践中的不足;最后提出了构想,包括明确法庭翻译人员的法律地位、建立法庭翻译人员准入制度、翻译人员登记制度、完善翻译质量保证制度等。

The establishment of court interpretation system in practice becomes increasingly urgent. This thesis introduces the present status of court interpretation system in the China, makes some analysis into its setbacks and puts forwards some suggestions on the completion of the system, including rights and duties of court interpreter, admission system, registration systems and quality guarantee system etc.
