略论我国《刑法》新增设的人体器官犯罪

On The Newly-Created Crime Of Human Organs In China Criminal Law

近年来,我国非法贩卖人体器官危害行为日益呈现组织化、专业化和智能化的特点。由于打击非法出卖人体器官行为的立法不够完备,我国有关人体器官危害行为日益猖獗。基于此,我国国家立法机关在《刑法》中增设了人体器官犯罪,设置了组织出卖人体器官罪,并对相关犯罪行为以故意伤害罪、故意杀人罪和盗窃、侮辱尸体罪论处,掀开了《刑法》对相关法益和法秩序保护的新篇章。

In recent years,the acts about illicit trafficking in human organs are increasingly organized,professional and intelligent.As the legislation on illegally selling human organs is not complete,the acts are rampant.Based on this,China's national legislature added the crime of selling human organs,setting up the crime of organizing to sell human organs and the related acts constituting the crime:intentional assault,intentional homicide,theft,the crime of insulting the body.It has opened a new chapter of the protection of the related legal interests and legal order.
