理性辨析“影响性诉讼”和“媒介审判”之社会影响

网络舆论作为当前一种重要的社会现象,从构建公众社会话语权、培养公众民主意识和参与意识、发挥舆论监督等方面,有效促进了政治参与和司法公正的建设。然而,由于网络舆论所具有的开放、匿名、免责特性,本身无可避免地有一些缺陷和偏差,过度泛滥和缺乏引导将对司法理性与独立造成冲击。因此,处理好"影响性诉讼"和"媒介审判"与司法独立和理性之间的关系,需在完善舆论监督和公众监督与司法公开和对待媒体的正确态度中找到平衡。"影响性诉讼"与司法公开地互动,逐渐让网众养成对法律的尊重和对司法理性与公正的更成熟理解。

At present, network opinion is an important social phenomenon, which effectively promotes the constructions of political participation and fair judicatures by way of providing the right of social opinions, cultivat- ing public democratic and participating ideology and carrying out mass supervisions. Wheras with the special fea- ture,~ of opening up, anonymity and exempt from responsibility, it unavoidably has some shortcomings and devia- tions. It may pound at the rational and independent judicature without control and correct guidance. So if we want to build good relations of ＂influencing lawsuits＂ and ：media judgements＂ with independent and rational judica- ture, we should find balance between public supervision and public judicature and correct attitude toward media. ＂Influencing lawsuits＂ and public judicature should have mutual activities and gradually the web - citizens can re- spect the laws and understand rational and fair judicatures.
