行政强制作为行政主体实现行政管理目标的基本手段,以强制性和损益性为基本特征。行政强制既直接影响着行政管理效率,同时更与公民权利保护密切相关。因此,从公民权利保护角度出发,在行政强制中必须融入民主、法治、合作、人权的宪政精神。
