摘要
"不可替代行为"所具有的特定人身"依附性",是该类行为与"可替代行"最为基本的区别。为了规范执行实践中对于"不可替代行为"的强制执行,我国立法上应当对于"不可替代行为"强制执行的"例外"、"执行规则"、"执行程序"、不履行"不可替代行为"条件下的"损害赔偿"等,作出明确规定,并对某些"不可替代行为"的结案期限做不同于一般执行的调整。
＂Personal dependency＂ which specially possessed of ＂irreplaceable act＂ is the most basic difference with ＂ alternative act＂. In order to standardize the implementation of practice for the ＂irreplaceable behavior＂ to compulsory execution, the legislation should be make clarify for ＂compensation for damages＂ under the conditions of ＂exception＂, ＂implementation rules＂ ,＂ execution＂ at the compulsory execution for the ＂ irreplaceable act＂, and adjusting the time limit of closing the cases related ＂irreplaceable act＂ and which have different from the normal execution process.
