Empirical Study on High Mediation Rates of Criminal with Civil Litigation——An Analysis Based on "Compensation for Leniency"

刑事附带民事诉讼调解能有效地减少矛盾对抗,缓解情绪对立,平衡利益关系,促进社会和谐,是人民法院在刑事司法领域的重要司法举措,也因此有着较高的调解率。对两种案件类型的实证分析表明,"赔偿从宽"在实践中大力促成了刑事附带民事诉讼调解,成为影响高调解率的一个重要因素。

Criminal with Civil Litigation Mediation can efficiently reduce conflicts and confrontation,ease the emotional confrontation,balance the interests and promote the social harmony.It is the improtant justice initiatives of the People＇s Court in the field of criminal justice,so Criminal with Civil Litigation has a high mediation rate.In the text,the empirical analysis of the two types of cases indicates that the ＂Compensation for Liberal＂ in practice contributes a lot to the Criminal with Civil Litigation Mediation,which becomes an important factor to affect the high mediation rate of Criminal with Civil Litigation.
