On the Conflict and Coordination between Intellectual Property and Human Rights

当代知识产权权利的扩展导致知识产权制度本身所蕴含权利平衡机制被打破,对人权保护造成了冲击。知识产权与人权冲突的深层次原因是两种权利背后蕴含的利益冲突。协调知识产权与人权冲突要遵循权利优位原则、利益平衡原则、权利保护与社会经济发展相适应原则,对知识产权人的权利进行适当的限制,并建立知识产权制度的人权审查机制。

The contemporary expansion of intellectual property rights causes the inherent balancing mechanism in intellectual property rights system itself was broken,causing the impact on human rights protection.Deep-seated reasons of intellectual property rights conflict with human rights is behind the inherent conflict of interest rights.To coordinate conflict between intellectual property rights and human rights should follow the rihgt priority principle,the principle of balance of interests,rights protection and adapt to social and economic development principles,restrict the rights of intellectual property appropriately,and establish human rights review mechanisms for intellectual property system.
