摘要
类推解释不是推理方法在法律解释中的纯粹逻辑运用,而应视作为一种狭义的法律解释方法。明确类推解释的概念和系属问题,将更有助于狭义法律解释方法的系统科学性的建设。他们的准确适用有利于把握法律条文语义内涵、法律意蕴和社会意义,推动法律适用的有效性与公平性目标的实现。
Analogical interpretation is not purely the application of logical inferencing in legal interpretation. It should he looked upon as a narrowly-defined method of legal interpretation. The clarification of the concept and ascription of analogical interpretation is beneficial to the construction of the scien- tific system of legal interpretation. Its precise application helps dig out the intension, legal implicature and social significance of legal clauses, and promote the validity and justice of legal application.
