摘要
法律推理是在具体语境中进行的。法律推理的大前提不是直接发现的,而是以语境为基础确立的。语境是选择法律条文、厘清法律条文中的模糊表述、弥补法律漏洞的基础。法律推理的小前提也不是给定的,而是根据语境建构出来的。语境是进行事实表述的过滤器,是形成法律事实共识的依据。法律推理结论的正确性在于可接受性,而语境是其可接受性的检验标准。
Legal reasoning carries out in the specific context.The major premise of legal reasoning is based on the context.According to the context,we choose the law,clarify blurring in the legal rule,and fill the legal loopholes.The minor premise of legal reasoning is constructed according to the context.Context is the filter of the fact expression and the basis of the formation of legal fact consensus.Correctness of the conclusions of legal reasoning lies in acceptability,but the context is the touchstone of its acceptability.
