中国农村宅基地使用权流转的正当性辨析与立法构想

中国现行法律法规及相关政策严格限制农村宅基地使用权的流转,与市场经济条件下农村宅基地使用权流转的现实需求不符。允许农村宅基地使用权的流转与耕地保护并不矛盾,而农村宅基地使用权的生存保障功能也应被社会保障体系所替代。中国农村宅基地使用权流转的制度立法改革要有步骤地进行,改革初期宅基地使用权可以先允许有限制的流转,等待配套制度建设成熟后再推行自由流转。

China＇s existing laws,regulations and related policies strictly limit the transfer of rural land use right,and does not match the reality needs of rural land use right transfer in the market economy.Allowing rural residential land use right circulation is not in contradiction with the cultivated land protection,and life-support functions of rural land use right should be replaced by the social security system.Chinese legislative reform of rural housing land use right should be carried step by step.The land use right can be allowed to circulate in restriction in reform initial,and then free flow when the supporting systems be built to mature.
