论外汇管制的国际私法规则

Exchange Control in the Private International Law

虽然《基金协定》第8条第2款(b)给予外汇管制法规更大程度的承认,但是法院仍然可以根据国际私法规则决定是否承认其他国家外汇管制法的效力。即使某国的外汇管制法是合同准据法的一部分,若其采用了武断的、迫害性的或者歧视性的手段,法院仍可以根据本国的公共政策拒绝承认。文章将从外汇管制的性质谈起,对有关外汇管制的国际私法规则进行归纳、分析,并得出自己的结论。

Although the IMF Agreement＇s Article 8 Section 2（b） renders the recognition of the exchange control regulations to a greater degree, the court can still decide whether they should acknowledge the other countries＇ exchange control regulations according to the rule of private international law. In that case, even if a certain country＇s exchange control regulation is the governing law of contract, the court still could refuse to acknowledge it on the basis of the domestic public policy if the contracting parties employ any discriminative, arbitrary, or persecutive approach. The paper starts from the nature of exchange control regulation, then analyzes the rule of conflict law about exchange control, and finally reaches a conclusion.
