网络服务提供者的版权侵权责任新探——基于《侵权责任法》的分析

基于《侵权责任法》的相关规定,探讨网络服务提供者的版权侵权责任。认为对网络服务提供者的版权侵权责任应适用过错责任原则;在认定网络服务提供者的过错时,应将"知道"解释为"明知",并应为网络服务提供者采取必要措施设置必要的门槛;对网络服务提供者的赔偿范围,可采取法定赔偿制度。

The article has studied on the copyright infringement responsibility of the network service provider on the law of tort liability. The tort liability should apply the principle of fault. The ＂Know＂ should be interpreted as ＇~,lready known＂. The network service provider should be set necessary conditions if he took necessary measures. The scope of compensation of the network service provider shoud apply to statutory compensation system.
