国际海底区域制度发展中的若干争议问题

Some Pending Issues in the Development of International Seabed Area Regime

国际海底区域制度在最近10年中获得了一定的发展,主要体现在国际海底管理局通过了两个探矿和勘探规章,但在立法中存在的几个重大争议问题,即勘探区域的重叠主张问题、反垄断问题和担保国的义务和责任问题,由于关涉各国的重大利益,在谈判中虽几经波折,但仍未能在现有规章中予以有效解决。我国作为国际海底区域的主要开发国,受到这几个问题的影响较大。因此,在立法中态度十分积极,发挥了重要作用,现有的安排应该说基本符合我国利益。

There are some developments in recent 10years about the international seabed Area regime. The International Seabed Authority adopted two Regulations, but some important issues such as overlapping claims, anti - monopoly and the responsibility and liability of sponsoring state are not dissolved effectively in these two Regulations. As a main exploring state in the Area, Chi- na was very active in the process of legislation and succeeded in influencing the draft and adoption of Regulations to obtain a positive result for our interest.
