摘要
法的功能具有客观性,法的功能选择的状况直接影响着法的价值的实现。法律的功能范围是不断发展完善的,这要求法的主体应该依照不同的社会状况选择适合社会现实的法的功能组合才能实现法的价值追求。现实中,为保证能源安全目标的全面实现,立法者需要综合考虑影响能源法功能选择的思想、实践及法律等基本因素。
Though the functions of law ought to be objective,the selection and confirmation of law＇s functions plays a major role in implementing its values.Meanwhile,the functional scope of the law is constantly developing,which requires legislators should select combination of the functions of law according to different social conditions to realize the value of law.In reality,to ensure the full realization of energy security goals,legislators need to consider the comprehensive impact of the fundamental factors of ideas,practicing and law affecting the selection of energy law function.
