随着信息化时代的来到,人们的生活越来越信息化、数字化。电子证据给传统证据制度带来了很多挑战。电子证据具有一些特殊的属性,如不易固定性、依赖性、形式多样性、客观真实性以及高科技性。通过分析电子证据取证存在的风险,对电子证据收集过程中提出相应的建议和目前工作中面临的困惑,加强和提高基层检察院对电子证据取证问题的认识和重视,建立和完善电子证据取证体系,保证今后检察办案工作的顺利开展。

With the advent of information era,the people＇s life becomes more and more digital. The e-evidence has brought many challenges to the traditional evidence system. The e-evidence has many special characteristics,such as difficult to fix,dependency,diversity,truthfulness and high-technology. By analyzing the risks in e-evidence and e-evidence collection process,some suggestions are made accordingly,thus to strengthen and improve the understanding of e-evidence collection of the grass-root procuratorates,to establish and perfect the e-evidence collection system,and to ensure the smooth development of procuratorial work.
