透过国际人权法和部分国家立法审视中国同性恋现状及建议

On the present situation of the China's homosexuals and legislation suggestions through the International Human Rights Law and part state legislation

同性恋是一个敏感的话题(至少在中国),同性恋者广泛分布在世界的各个国家之中。作为人类的一分子,同性恋者应当享有和异性恋者同样的权利,这是国际人权的必然要求。世界各国对同性恋的态度和做法大相径庭,但目前很多西方国家已经形成了保护同性恋权益的法律。可以说,加强对同性恋权益的保护,是尊重和捍卫人权的必然要求,是大势所趋。而同性恋者在当代中国的地位并不明朗,1997年修改后的刑法虽没有明确禁止同性恋行为,但也没有任何一部法律承认同性恋者的地位。中国作为一个在国际上越来越多的展现自我之国家,更应该顺应历史潮流,正视同性恋问题,积极保护同性恋者的权益,以此来展现一个尊重人权的民族之伟大风貌。

Homosexuality is a sensitive topic （at least in China）, homosexuals widely distributed among the various countries in the world. As a member of the human race, homosexuals should enjoy the rights with heterosexuals equally, it is the inevitable requirement of international human rights. The world attitude and approach to homosexuals vary wildly, but now many western countries have formed laws to protect heterosexual rights. It can be said that strengthen protection to homosexual rights is the inevitable requirement of respecting and protecting human rights. It is the trend of time. Homosexuals in contemporary China＇ s position is not clear. In 1997, after modification of criminal though no laws bans homosexuals＇behavior specifically, but no one law admits homosexuals status. China, as a state which more and more shows itself to the world, more should conform to the historical trend, face homosexuality, so as to show a great national character of respecting human rights.
