摘要
介绍了我国林地保护的立法状况,阐述非法占用林地的法律责任,分析了我国《森林法》及其配套法律法规在执法实践中存在的不足,从立法、执法及其管理的角度上对我国林地保护提出对策措施,为《森林法》及其配套法律法规的修订提供理论依据,为林业司法、执法及其规范管理提供参考。
This paper introduces the legislative situation in the forest woodland protection, expounds the legal responsibility of illegally occupied forest woodland in China, analyzes the shortage of the Forestry Act and related laws and regulations in the practice of enforcing the law, puts forward some viewpoints of woodland protection in our country form the legislation,enforcement and management, provides theoretical basis for revising the Forestry Act and related laws and regulations, offers some reference of the forestry law enforcement and standard management.
