继承作为一项重要的民事制度与人们的社会、经济、文化、家庭生活息息相关,作为取得财产的重要方式,历来为人们所重视,在司法实践中绝大多数的继承纠纷源于继承人对遗产的争夺,但是放弃继承在实践中亦不鲜见,当遇有继承人放弃继承时,是否会侵害了他人的共同财产,常有争议;我国关于继承权放弃的司法较为抽象和原则,实务中缺乏可操作性,有必要对继承权放弃的相关问题进行探讨。

Inheritance,as one of important civil systems,is closely linked to people＇s social,economic,cultural and family lives.In addition,as an important way of obtaining property,it has always been attached much importance by people.In judicial practice,the vast majority of the inheritance cases stemmed from the disputes and competition to the estate between different heirs,it is uncommon to find abandoning heirdom in practice.It is controversial whether the heirdom abandonment would infringe the others＇ common property of when a heir abandons his heirdom.Chinese Inheritance Law is Abstract about the act of heirdom abandonment,and the laws lack operability in practice.Therefore,it is necessary to make a deep study on the issues related to abandonment of heirdom.
