惩罚性赔偿若干问题研究

惩罚性赔偿只有在法律明确规定情况下才能适用,但它对受害人的救济更为彻底。英美法系的惩罚性赔偿早已有之,大陆法系也逐渐接受并开始适用惩罚性赔偿。我们应当借鉴国外先进立法经验,在违约、侵权等领域全面确立惩罚性赔偿制度。当前我国惩罚性赔偿适用范围有限,有必要在严重侵害人身财产领域和重大环境领域适用惩罚性赔偿,但是应明确惩罚性赔偿的适用范围、为受害人设置更高的证明标准并限制惩罚性赔偿金数额,以防止滥用惩罚性赔偿。

The punitive damages have more compensation for people though it is only used when the law clearly states.Common law countries established punitive damages earlier,but continental law countries also have been accepted and applied to it.In our country,we should borrow legislative experience from other countries,and established punitive damages system in the field of contract and tort.However,the scope of its applicability is limited,it is necessary to use punitive damages in the field which may be hazardous to personal and property safety or the environmental tort.In order to avoid abusing the punitive damages,it should establish it＇s precise scope and higher standard of proof,also should set the limit of the amount of money.
