论农村土地承包经营权的流转问题

On the transfer of the rural land contractual management right

农村土地承包经营权的流转问题,对我国的经济社会发展均具有重要影响。本文首先提出了农村土地承包经营权流转的现存问题;然后,本文通过对农村土地承包经营权流转的立法理念、流转主体及其法律关系、流转方式、流转的市场环境等进行分析与思考,指出其现存问题的原因所在;最后,根据对问题与原因的分析,提出了相应的对策与建议。

The transfer of the rural land contractual management right is very important for the economic and social development of China. Firstly, this paper indicates the existing problems of the transfer of the rural land contractual management right in China. Secondly, this paper points out some reasons for the problems mentioned above by analyzing the legislative ideas, the relationship among the subjects participating the transferring, the transfering method and market environment of the transfer of the rural land contractual management right. Finally, this paper puts forward some corresponding countermeasures and suggestion for the solution of these problems.
