检侦关系改进论——以公安机关考核机制对退回补充侦查的影响为视角

On the Improvemdnt of Procuratorate-Investigation Relationship——From the Perspective of the Influence of Assessment Mechanism of Public Security Organ on the Return of Cases for Supplementary Investigation

检察机关与公安机关作为刑事诉讼"流水线"上的两个重要环节,其相互关系对于维护犯罪嫌疑人的合法权利、保障诉讼效率具有极为重要的影响。本文以退回补充侦查为例,通过对于某省三市三年来相关数据分析,对检侦关系重新进行审视并提出改进建议。

The procuratorate and the public security organ are the two significant links of the ＂assembly line＂ of the criminal procedure,and the relationship between them has an extremely important influence on maintaining the legitimate rights of criminal suspects and ensuring the litigation efficiency.Taking the return of cases for supplementary investigation for example,this paper will reconsider the procuratorate-investigation relationship and provide advice of perfection by analyzing related statistics of a certain province in the past three years.
