论我国国家赔偿应引入惩罚性赔偿制度

A Brief Analysis of Introducing the Punitive Damages System to the State Compensation in China

我国现行的国家赔偿制度是以抚慰性赔偿为主,功能也仅限于补偿,没有惩戒违法行为和预防违法行为发生的作用。而惩罚性赔偿不仅具有补偿之功能,更具有惩戒和威慑违法行为的作用,引入惩罚性赔偿制度对于完善我国国家赔偿制度以及预防冤假错案都具有重要的意义。

The current national compensation system in China is mainly soothing compensation and the function is limited to offset, so there are no functions of punishing the disciplinary violations and preventing the illegal behaviors. However, the punitive damage system has not only compensation functions but also punishing and preventing functions. Therefore, it is meaningful to introduce the punitive compensation system to the national compensation system and can decrease the false and wrong cases.
