标准中纳入专利的现状分析及对策研究

本文通过分析ISO、IEC、ITU三大国际标准组织涉及专利的标准历年分布情况,发现在三大组织中,涉及专利的标准数量最多的是ITU,增长速度最快的是IEC,标准中纳入专利的情况还是较多地出现在信息技术和高新技术领域中;首次对我国国家标准中涉及专利的情况进行了梳理和分析,从采标和自主制定国家标准的角度分析了我国国家标准中纳入专利的情况及其发展趋势,提出了完善我国标准中专利信息搜集的建议。

This paper analyzes the annual number of ISO, IEC and ITU international standards including patents. The conclusions are those the largest number of standard including patents are ITU international standard, the fast growing one is IEC international standard, and standard including pantents is more likely to appear in the field of information technology and high-tech. This paper also firstly analyzes the states of our national standard including patents, statistics the situation and trend of patents inclusion in our national standards from the point of adoption and self-develops of standard, gives some advice on how to improve the collection of patent information included in our national standards.
