摘要
基于对林权的物权化改造,将林权界定为森林资源承包经营权,并以林权抵押特征分析为切入点,进一步厘定林权抵押的概念。在此基础上,从重庆林权抵押立法现状出发,探讨其存在的局限性,并提出了完善林权抵押制度的建议:制定全市林权抵押融资专项立法、抵押物范围的拓宽、抵押权人主体扩大、抵押限制制度的完善、抵押物收回与抵押权人的保护。
Based on the property transformation of forest rights,the forest right is defined to be the contractual management of forest resources.Through analyzing its features,the mortgage of forest right is further clarified.Based on the registration status of Chongqing forest right mortgage,the limitations are discussed and the suggestions for improving the mortgage system are proposed: formulating special laws for the mortgage and financing of forest right,broadening the scope of mortgaged property,expanding the main body of mortgagees,improving the mortgage restrictive system,recovering mortgaged property and protecting the right of mortgagees.
