土地承包经营权独立补偿问题研究——以《物权法》与《土地管理法》的衔接为中心

Independent Compensation of Contracted Land Ownership

土地承包经营权能否独立补偿已成为土地征收补偿中的焦点问题之一,但征收实务中并未充分关注土地承包经营权的独立地位。依《物权法》第121条、第132条的文义解释,《物权法》规定的征收制度的体系性解释以及《物权法》与《土地管理法》之间的体系性解释,土地承包经营权人可以基于其用益物权请求征地补偿,且该请求权独立于土地所有权人的征地补偿请求权。在具体操作上,不应将承包经营权的补偿纳入土地所有权的征地补偿费中,而应参照土地所有权的补偿标准予以确定。

Whether contracted land ownership may receive independent compensation complemented in the process of government land acqisition has been a topic of great importance in China, but in practice it is usually ignored by the government. In accordance with China＇s Property Act articles 121 and 132, the contracted land owner is eligible for compensation for any other use of his land by the government, i.e. the actual owner of the land.
