在当今社会,著作权与物权的区分并不十分的显著,传统民法在物权变动方面的理论完全可以运用于著作权的转让。著作权转让中的物权合意乃是客观的存在,著作权转让具有独立性和无因性。我国著作权转让变动模式应当采用"形式主义"模式,著作权变动之公示效力应适用"登记生效要件主义"的模式。

In todayg society, the distinction between copyright and property right is not very significant and traditional theory of civil law in changes in property rights can be completely applied to the transfer of copyright. Agreement of property right in copyright transfer is objective reality and the copyright transfer is characterized by independence principle and unreason principle. Change mode of China＇s copyright should be a ＂formalism＂ one and the demonstration effect of copyright change should apply to ＂registration effectiveness＂ mode.
