论船员外派企业的法律地位

船员外派企业的法律地位问题始终是学术界讨论的热点问题。本文根据我国现行法律对船员外派企业的相关规定,分析了船员外派企业的法律性质,同时对其在船员外派三方主体中的法律关系进行了研究,进而明确了船员外派企业的具体权利和义务。最后,文章在结合我国相关立法的基础上,从雇主责任分担的角度出发,提出了完善船员外派企业法律规制的立法建议。

Legal status of foreign seafarers dispatch enterprises has always been the hot topic the academic circles discuss.According to the current relevant regulations about foreign seafarers dispatch enterprises in our country,this paper has analyzed the legal nature of foreign seafarers dispatch enterprises,and studied the legal relations among three parties in foreign seafarers dispatch and then made clear the specific rights and obligations.Finally,combined with relevant legislation of our country,from the perspective of liability allocation of employer,the paper has proposed the legislation suggestions of improving laws and regulations regarding foreign seafarer assignments enterprises.
