试论公权力异化的生成机制与控制路径

On the Formation Mechanism and Control Path of Public Power of Alienation

公权力是维护社会秩序、保障私权利的重要力量。同时,公权力的异化又直接侵害公民的合法权利甚至社会公共利益。各种利益的内在驱动机制、不合理的政绩考核机制、软弱乏力的权力监督制约机制是公权力异化的生成根源。公权力的限度明确化、政绩考核体系科学化、权力监督制约有效化是控制公权力异化的根本路径。

Public power is an important force to maintain social order and to protect private fights. Meanwhile, the publle power of alienation is directly against the legitimate rights of citizens or even public interest. Various interests drive mechanism, unreasonable performance evaluation mechanism and the power of weak supervisory mechanism are the publie source of power alienation. Therefore, the clarified limits of power, scientific performance evaluation system, and effective supervision and control of power are the fundamental path to contrel the alienation of public power.
