100-Year Reflections:A Study of Inscriptions on Oracle Bones and the Legal System of Shang Dynasty

百年来的商代法制研究取得丰硕成果,而甲骨文资料的使用对促进商代法制研究起到了举足轻重的作用。然而,以甲骨文字形结构分析为主流的研究方法存在问题,使我们要重新审视这些成果的可靠性。迄今为止所建构的商代国家与法制的框架恐怕只是一个假说。今后的商代法制研究,需要各学科学者的通力合作,更需要在资料与方法上多下些功夫。

Plenty of fruits have been born out of research on the legal system in Shang Dynasty over the last 100 years. It is to be noted that the use of relevant inscriptions on oracle bones has played a decisive role in promoting research on the legal system of Shang Dynasty. However, there are problems with the research method that analysis of the character - shape structure of inscriptions on oracle bones is taken as the main stream. That is why it is necessary to reexamine the reliability of the above - mentioned fruits. The framework of the states and legal systems in Shang Dynasty that had been set up up to then was perhaps a hypothesis only. Future studies of the legal system in Shang Dynasty call for vigorous cooperation of scholars from different disciplines and require even more effort to utilize proper materials and methods.
