缔约过失责任的赔偿范围探析

建立科学合理的缔约过失责任赔偿范围,对于维护契约公正安全,保护当事人利益具有重要的意义。本文认为信赖利益的直接损失是缔约过失责任赔偿范围的主要内容,机会利益应该纳入信赖利益的赔偿范围,固有利益损害包含在缔约过失损害赔偿范围中,缔约过失责任损害赔偿范围中还应包含非财产损害的赔偿。

The establishment of the scientific and reasonable scope of compensation is very important to maintain the fairness and safety of a contract and safeguard the party＇s right.This paper holds that the direct loss of reliance interest is the main content of compensation scope of liability fault,opportunity interest should be included in the compensation scope of reliability fault and the loss of inherent interest should be included in the compensation scope of the loss of liability fault.Moreover,the compensation scope of the loss of liability fault should contain the compensation of non-property loss.
