不正当竞争行为的新形态及其规制研究

Research on the New Forms of Unfair Competition and Its Regulation

我国《反不正当竞争法》第五至十五条列举了该法规制的不正当竞争行为,主要是混淆行为、虚假宣传行为、侵犯商业秘密行为、低价倾销行为、商业诋毁行为等11种。但是,随着社会经济生活的不断发展和进步,不正当竞争行为也呈现出新的形态,目前有关法律规定的不正当竞争行为不能涵盖层出不穷的不正当竞争行为。面对反向假冒、比较广告、新型混淆行为、附赠式有奖销售等新型不正当竞争行为,需要将这些行为纳入到《反不正当竞争法》的调整范围内加以规范,以建立良好的竞争秩序。

Article 5 to15 of China＇s ＂Anti -Unfair Competition Law＂ list 11 kinds of unfair competitions, mainly including confusion acts, misleading propaganda, infringing commercial secret, anti - dumping at a low price, cornmercial slander. But along with the advance of the society and economy, some new types of unfair competitions have come into being. And the current ＂Anti -Unfair Competition Law＂ cant cover all kinds of unfair competitions. Facing with new forms of unfair competitions like inverse passing -off, comparative advertisement, new type confusion behaviors and premium sales which feature unfair competition, we need to bring them into the range adjustment of ＂ Anti -Unfair Competition Law＂ and regulate them, so we can establish a favorable competition order.
