完善人大代表候选人的提名制度——从限制公务员候选人资格限制角度

To Perfect Nomination System of NPC Deputy Candidates——from the Perspective of Limiting Qulifications of Public Servant Candidates

由于我国对于候选人没有资格限制、对执政党提名缺乏规范、联合提名受到种种限制等原因现在的人大代表中存在着公务员代表比例较高,导致不能实现司法权、行政权和立法权之间的分工与合作的关系,弱化人大的监督职能,使代表议事职能行政化,难以履行代表职务的时间保障。在现阶段在对候选人的职业资格不可能限制的情况下,为了降低公务员代表的比例,希望从完善候选人提名制度来解决。

Due to the causes of no limitation in the candidates＇ qualifications,the lack of standards for the nomination of ruling party,and various limitations in joint nomination,the high rate of public servents in NPC deputies has caused a series problems such as the impossible realization of division and cooperation among jurisdiction,executive power and legislative power,weakening NPC＇s supervision function,administration of the NPC memebers＇official discussion function and no time guarantee for deputes to carry out their duties.In order to lower the rate of the public servants in NPC members,we should improve the candidates＇ nomination system,under the current situation of impossible limitations in the candicates＇ profession.
