摘要
基于劳动争议主体间法律关系的特殊性,用人单位在证据占有、收集、提供、举证能力等方面,都优于劳动者。因此,规范用人单位在劳动争议中占有、收集、提供证据的行为,强化其举证责任,不仅有利于查明劳动争议的事实真相,也有利于从程序上保障争议的公平公正解决,它将从实体上维护劳动者的合法权益,进而促进劳动关系的和谐稳定。
Based on the particularity of labor dispute between the main legal relationships,the employing units are superior in possession,collection,provide evidence,burden of proof and so on,to those of workers.Therefore,for employers in labor dispute possession,collection,provide evidence of behavior,strengthen its burden of proof,not only facilitates the identification of the fact of labor dispute,also ensure the procedure of security disputes fair solution,it will protect from the entity the legitimate rights and interests of workers,hence promote harmonious and stable labor relations.
