Research on the Issues of Marital Right for Prisoners in Views of Harmonious Society

在和谐社会视野下,服刑罪犯的同居权问题一直备受关注。从理论上说,服刑罪犯同居权是尊重和保障基本人权的宪法原则的依据和体现,是罪刑法定原则的自然延伸。服刑罪犯同居权的实现是其生理上的现实需要,也有利于矫正罪犯,构建和谐社会。服刑罪犯同居权的实现,要从服刑罪犯的受益面与监狱自身的实际相结合。

The issues on prisoners＇ marital rights have been focused on in harmonious society.Theoretically,prisoners＇ marital rights embodied constitutional principles of respecting and guaranteeing basic human rights and extends naturally the principle of crimes and penalties.The grant of prisoner marital rights will be helpful of correcting criminals and meet their physiological needs so as to construct harmonious society.Meanwhile,to grant prisoners marital rights should be combined with the benefit of prisoners and their prison conditions.
