Analyzing Contemporary Protection System of Transaction Security

随着交易安全保护制度在当代逐步走向成熟,交易安全保护方法日趋多样化。现代交易安全制度不仅要保障履行利益的取得与实现,还要保障信赖利益的安全,包括缔约中的信赖保护和信息公开领域的信赖保护。在保护外观信赖时,或者按照当事人信赖的外观确认交易有效,或者直接要求当事人承担信赖利益赔偿责任;而对交易过程的保护,也实现了连贯与周密。我国应借鉴并尽快建立交易安全的成熟理论与制度。

The protection method of transaction security is becoming diversified by the procedure of protection system of transaction security grown maturity gradually.It should ensure not only the profit but its security including reliance protection both in contract and information-public field.On protecting appearance reliance,we can either recognize the transaction as being valid by the client trusting in appearance,or ask for directly liability to pay compensation;and coherent and thorough protection are received in the process of transaction.China should borrow the experience and establish the mature theory and system of transaction security as soon as possible.
