论我国南海主权主张中的“附近海域”

我国对南海诸岛及其附近海域拥有无可争辩的主权。此"附近海域"为附属于上述岛礁并应归属我国的领水部分,包括内水及领海。"附近海域"的具体范围,应在确定南海诸岛领海基点和划定基线的基础上,依习惯国际法及我国参加的有关公约加以明确并标识。

China has indisputable sovereignty over the South China Sea＇s islands and their surrounding waters.The surrounding waters,which consists of territorial sea and internal waters of the South China Sea＇s islands,is a part of China＇s territorial waters.The boundary of the surrounding waters shall be ascertained and charted in accordance with customary international law and the international conventions into which China has accessed,based on the selection of base points and the drawing of baseline.
