摘要
立法目的是整个立法的灵魂,能源立法目的的确立及其价值取向的选择对于能源立法来说有着十分重要的意义。我国能源法体系尚不完备,在立法目的和处理能源利用与环境保护的关系之间存在偏差。要解决好这个问题,就要重新思考、定位能源立法目的及其价值取向的选择。
The aim of law is the soul of the whole legislation. Establishing the aim of and the value orientation of choice for energy law makes great sense in energy legislation. In China, the construction of the system of energy law is on the way, and there is a mistake for establishing the aim of energy law and the relation between energy use and envirionment. To solve this problem, we should rethink and reestablish the aim of energy law and the relation between energy use and envirionment.
